hereinafter referred to as the provider, the contract is concluded.

Subject matter of the contract
This contract regulates the sale of new goods in the field of art, handicrafts and instruments. For details of the respective offer, please refer to the product description on the offer page. Any decorative items in the exhibited pictures and photos are not part of the contract, unless this is expressly mentioned in the description.

Conclusion of contract

The contract is concluded individually. The offers presented represent a non-binding invitation to submit an offer through the customer order, which the provider can then accept. The order process for the conclusion of the contract comprises the following steps:

1 Written notification of the customer's interest in purchasing under the conditions stated in the offer via email or messenger.

The contract is concluded when the order confirmation is sent.

Contract duration
The contract is concluded for an indefinite period.
The delivered goods remain the property of the supplier until full payment has been received.

Prices, shipping costs, return costs
All prices are final prices and do not include VAT according to § 19 Abs. 1 UStG. Shipping costs are country-specific and are shown separately on the invoice. There is a right of cancellation and if this is exercised, the customer bears the costs of the return shipment. The shipping costs for Germany are €7.49, for all EU countries €17.99 and for Switzerland €29.99 (as of 06/2021). Shipping to other countries does not take place.

Terms of payment
The customer only has the following options for payment: advance bank transfer, cash on collection, Paypal. Other payment methods are not offered and will be rejected. The invoice amount is to be transferred in advance to the account specified on the invoice, which contains all details for the bank transfer and is sent by e-mail. The invoice amount can also be paid in cash at the provider's address during normal office hours after deduction of the shipping costs. The customer is obliged to pay or transfer the stated amount to the account specified on the invoice within seven days of receipt of the invoice. Payment is due without deduction from the invoice date. If the invoice amount is not credited to the account within 7 days, the contract shall lapse and the goods shall be offered for sale again. Any right of retention on the part of the customer which is not based on the same contractual relationship is excluded.

Terms of delivery
The goods are dispatched immediately after receipt of the invoice amount. On average, dispatch takes place no later than one day after receipt of the invoice amount. The standard delivery time is 4 days, unless otherwise stated in the item description. The supplier shall dispatch the order from its own warehouse. If the provider has a permanent obstacle to delivery, in particular force majeure or non-delivery by its own suppliers, although a corresponding covering transaction was made in good time, the provider has the right to withdraw from a contract with the customer in this respect. The customer shall be informed immediately and any services received, in particular payments, shall be refunded.
Contract designThe customer has no possibility to directly access the stored contract text. The customer can correct input errors during the ordering process. He can do this in the following way: written notification via email.

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the date,

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires.

Consequences of cancellation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.

You must return or hand over the goods to Max Ruf, Kreuzhütte 32, 41189 Mönchengladbach, phone 017634080058, samaru-flutes@gmx.de immediately and in any case within fourteen days at the latest from the day on which you inform us of the cancellation of this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

End of the cancellation policy

Prohibition of assignment and pledging
Claims or rights of the customer against the provider may not be assigned or pledged without the provider's consent, unless the customer has proven a justified interest in the assignment or pledge.

Language, place of jurisdiction and applicable law
The contract shall be drawn up in German. The further implementation of the contractual relationship shall be in German. The law of the Federal Republic of Germany shall apply exclusively. For consumers, this only applies insofar as no statutory provisions of the country in which the customer has his domicile or habitual residence are restricted. The place of jurisdiction is Düsseldorf.
